En el presente trabajo se analizan las principales soluciones del Reglamento (CE) núm. 864/ 2007 del Parlamento Europeo y del Consejo, de 11 de julio de 2007, relativo a la ley aplicable a las obligaciones extracontractuales (Reglamento Roma II). Este Reglamento unifica las normas de conflicto de los Estados miembros en materia de obligaciones extracontractuales con la finalidad de evitar el denominado forum shopping puesto que, con independencia del Estado miembro donde se litigue, la ley aplicable será siempre la misma; favorecer la seguridad jurídica; y, facilitar la libre circulación de resoluciones en el espacio judicial europeo.
This article analyzes the Regulation (EC) n. 864/2007 on the European Parliament and of the Council on the law applicable to non-contractual obligations (Rome II). The proper functioning of the internal market creates a need, in order to improve the predictability of the out-come of litigation, certainty as to the law applicable and the free movement of judgments, for the conflict— of-law rules in the Member States to designate the same national law irrespective of the country of the court in which an action is brought.
