The objective of the paper will be centred on analysing, from a legal perspective, the right of discontinuance of a contract of lodging, referring to where the client relies on this as a service of accommodation. As we know, this right consists of a voluntary declaration that the consumer - in this case the lodger – has unilaterally decided to put an end to the contract without providing any reason. As a consequence, the relationship - which by virtue of having been legally constituted, has consequent legal effects - is terminated. The Royal Legislative Decree 1 / 2007 of 16th November, by which the Revision of the General Law for the Defence of Consumers and Users was passed, devotes Articles 68 to 79 to the study of this said right; nevertheless, the application of these articles on the right of discontinuance of a contract of lodging are still uncertain and hindered by section b) of article 93.2 of the same legal text. Therefore our intention is to look for alternative routes which the client may rely on in the case of wishing to put an end to such a contract.

El objeto de la comunicación se centrará en analizar, desde una perspectiva jurídica, el derecho de desistimiento con el que cuenta el cliente de un servicio de alojamiento. Como sabemos, este derecho consiste en una declaración de voluntad en la que el consumidor - en este caso el huésped- decide unilateralmente poner fin al contrato sin alegar causa alguna. Como consecuencia, la relación válidamente constituida, que ya ha producido efectos jurídicos, se extingue. El Real Decreto Legislativo 1/2007 de 16 de noviembre por el que se aprueba el Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios dedica sus artículos 68 a 79 al estudio de dicho derecho; sin embargo, la aplicación de estos artículos al contrato de hospedaje resulta dudosa y obstaculizada por el apartado b) del artículo 93.2 del mismo texto legal, por lo que pretenderemos buscar vías alternativas con las que pueda contar el cliente en caso de querer poner fin al contrato que nos ocupa.
