Abstract

Los delitos contra la trata de personas aparecen en nuestro código y en el derecho comparado con una redacción muy similar por la marcada influencia de las normas internacionales y, muy especialmente, del protocolo de Palermo. Desde una perspectiva política criminal merece ser criticado que los legisladores no hayan hecho ningún esfuerzo de concreción y diferenciación y abarquen un conjunto de conductas que merecen valoraciones jurídicas penales distintas por su distinta gravedad. Como consecuencia de ello las penas aplicables resultan frecuentemente desproporcionadas. La actual redacción fundamenta el injusto de estos delitos en un elemento objetivo, que consiste en la desubicación de la víctima gracias a lo cual queda en una situación de vulnerabilidad y dependencia y, de un elemento subjetivo, que exige que la transferencia se haga con fines de explotación. En el presente trabajo abordamos desde esta polaridad el estudio del tipo.

The human trafficking crimes appears in our Criminal Code as well as in the comparative law with a very similar redaction due to the strong influence made by the international laws and, specially, for the Protocol of Palermo. From a political criminal perspective it must be criticized the attitude of the law maker for its lack of an effort in order to concrete and to difference the divergent criminal conducts that differs in their severity. As a result of this action the penalties to apply become excessive. The current redaction underlies the crimes in an objective and subjective item. The first one is focus on the victim dislocation provoking a state of vulnerability and dependency. The second element requires making the transfer with the purpose of exploitation. In the current paper we work from this polarity the analysis of the penal figure.
