Abstract

Este trabajo aborda la cuestión relativa a si los exdelegados sindicales, que han cesado en su cargo siguen protegidos durante el año posterior a la finalización del mandato desde el punto de vista del derecho de opción del art. 56.4 ET. Se hace a partir del la Sentencia del Tribunal Constitucional 229/2002. La Sentencia se centra directamente en la cuestión básica: el despedido era un exdelegado que había sido cesado por destitución de la sección sindical. Como sabemos el art. 68.c ET limita los efectos de la protección del año suplementario en los casos de revocación y dimisión. El nudo central de la Sentencia versa sobre si es posible o no aplicar analógicamente la misma respuesta en caso de destitución del representante sindical; es decir, ¿es posible asimilar la revocación del representante unitario a la destitución del representante sindical? En el trabajo se exponen las diferentes respuestas que se han dado a lo largo del iter procesal, por los Tribunales ordinarios que han precedido a la cuestión desde la vertiente constitucional, para terminar con el análisis del la Sentencia del TC. Fundamentalmente, la cuestión estriba entre asumir que existe dicha asimilación, de manera que la destitución debe tener el mismo resultado que la revocación; o entender que mientras la revocación es un mecanismo extraordinario que impide que finalice el mandato representativo por agotamiento de su duración, por el contrario la destitución es el procedimiento natural o normal que pone fin al mandato de la representación sindical. La opción del TC ha sido la segunda, si bien existen algunos interrogantes ante esta posición que merece la pena destacar.
