La protección de la privacidad en la sociedad tecnológica : el derecho constitucional a la privacidad de la información personal en los Estados Unidos

Abstract

La emergencia y el proceso de conceptualización del derecho constitucional a la privacidad de la información personal en el sistema constitucional norteamericano, reflejan la consideración de la privacidad de la información personal como un “valor constitutivo” que coadyuva a la configuración de la identidad individual y a la conformación social en el paradigma de sociedad democrático-tecnológica del siglo XXI. Sin embargo, las avanzadas tecnologías de las comunicaciones que en aras de la seguridad nacional contribuyen al desarrollo de medios de vigilancia más invasivos de la información personal al alcance de instituciones estatales, poseen la potencialidad de frustrar la participación ciudadana al amenazar la esfera privada y la autonomía individual, y, con ella, la sociedad democrático-tecnológica del siglo XXI. De ahí que la protección de la privacidad de la información personal con el máximo rango normativo resulte ineludible, aunque ahora la cuestión es si será suficiente el amparo de la Constitución nacional en el paradigma global de la Sociedad de la Información y del Conocimiento del Tercer Milenio.

The emergency and the process of conceptualization of the constitutional right to informational privacy in the American constitutional system, show the consideration of informational privacy as a “constitutive value” that promotes the configuration of the individual identity and the social conformation in the democratic-technologic society paradigm of the twentieth-one century. However, the advanced technologies of communications that in behalf of national security contribute to the development of more intrusive surveillance mechanism of personal information in the hand of national institutions, have the potentiality of discourage civic participation because they threat the privacy and individual autonomy, and, with this one, the democratic-technologic society paradigm of the twentieth-one century. Therefore, the protection of informational privacy with the higher law is inexorable, although the question is if the national Constitution will afford enough safeguard in the global paradigm of the Knowledge and Information Society of the Third Millennium.
