El aprendizaje basado en problemas aplicado al derecho tributario: una propuesta para la asignatura “Fiscalidad Internacional”

Abstract

En una asignatura optativa del ámbito jurídico, “Fiscalidad Internacional”, se ha ideado un sistema de enseñanza cuyo instrumento metodológico principal son los talleres o sesiones monográficas de trabajo que giran en torno a la resolución de casos prácticos (PBL). Según el formato diseñado, en cada clase se planteará un problema que se resolverá mediante la intervención contradictoria de alumnos que asumen el rol de portavoces o representantes de las diversas partes afectadas. Los objetivos de la actividad van dirigidos esencialmente a preparar la transición de los estudiantes a la actividad profesional una vez egresados. Gracias a la metodología participativa, en la que cada estudiante tiene que asumir responsabilidades directas en la resolución de los casos, el estudiante no sólo va a adquirir la competencia de un asesor fiscal especializado a juicio del profesor-evaluador, sino, lo que nos parece más importante, va a ser claramente consciente de su propia capacitación, porque ha visto cómo queda efectivamente probada.

In an optional legal subject, “International Taxation”, a learning system has been devised, which main methodological tool are monographic sessions based on case study (PBL). According to that design, in each session a problem will be suggested, which has to be solved through the conflicting intervention of students assuming the role of one of the parts concerned. The activity aims to prepare the transition of the students to the labor activity, once graduated. Due to the participative methodology, where each of the students has to assume direct responsibility in order to solve the problems, the student acquires not only a tax-advisor skills, but also becomes aware of his/her own proficiency.
