La punibilidad en la teoría del delito

Abstract

Uno de los temas más debatidos en la moderna teoría del delito es el acomodo de la punibilidad en dicho sistema, generalmente se atribuye a los elementos de la teoría del delito como una conducta, típica, antijuridica y culpable, desplazado a la punibilidad a lo sumo como una consecuencia jurídica. En el presente artículo trataremos de demostrar por qué dicha teoría resulta equivocada, por lo que se debe incluir a la punibilidad en la teoría del delito como un elemento más.

One of the most debated topics in the modern theory of crime is the accommodation of punishments in said system, it is generally attributed to the elements of the theory of crime such as a typical, unlawful and guilty conduct, displaced at the most as a legal consequence. In this article we will try to demonstrate why this theory is wrong, so punishable must be included in the crime theory as one more element.
