Abstract

Legal recognition of illness as a “work-related risk” has occurred much later, and has met with much more resistance and limits than that of “work-related accidents” (or accidents at work) in a strict sense. In Spain, the ambiguous definition of work-related accident set out in Law from 1900 onwards was the only slight hope for those seeking legal cover for work-related pathological processes until the first laws on silicosis came into force from 1940. Linked to a socio-demographic perspective that wonders about categories and filters that mediate the production of “data”, the analysis of a large sample of judicial sentences in litigation referring to this problem clarifies the nature and contents of the “risks” susceptible to recognition, their limits and their (modest) evolution throughout the last century (provisionally until the 1970s)
