Intervención penal y menor de edad

Abstract

This work analyzes the penal intervention regarding minors (underage) from two aspects applicable to the same subject: the minor, in legal terms, is the subject of certain rights that are especially protected in our legislation, given the defenselessness nature of his/her own existance. The foundation of it can be found in the absence of psychological maturity to govern himself/herself with entire independence, which makes minors even more vulnerable to crime, as well as (sometimes) more fragile with regards to its commission, probably due to different types of victim vulnerabilities (such as educational, familiar, social, legal-procedural, and so on). Therefore it would be necessary to distinguish between the two types of penal intervention. On the one hand, the intervention referring to the minor offender and, on the other hand, the one referring to the minor victim, although both tend to identify themselves in many of their aspects, since the minor, even being an offender, is also a victim after all. Hence the existing weak delimitation of both forms of declaration of his/her immature personality. However, it is absolutely necessary to be more specific about these two ways of penal intervention, since it will help us to determine the existing differences (between them) that can be found in our legislation, which have already been indicated in the whole extension of this study.

Este trabajo analiza la intervención penal en el menor de edad desde dos aspectos aplicables a un mismo sujeto: el menor que, jurídicamente hablando, es sujeto de unos derechos que están especialmente protegidos en nuestra legislación ante la indefensión de la que es originaria y potencialmente portador. El fundamento de ello podemos encontrarlo en la falta de madurez psicológica para gobernarse a sí mismo con total independencia, lo que hace al menor más vulnerable frente al delito, así como también a veces más frágil o lábil respecto a su comisión, probablemente por los diferentes tipos de carencia de los que a su vez puede ser víctima (educativa, familiar, social, jurídico-procesal, etc.). Por tanto, habría que distinguir dos tipos de intervención penal: por una parte, la referente al menor infractor, y por otra parte, al menor víctima, si bien a su vez tienden a identificarse en muchos de sus aspectos, pues al fin y al cabo el menor, aun siendo infractor, también es víctima, y de ahí la endeble delimitación de ambas formas de manifestación de su inmadura personalidad. No obstante, pese a lo anterior, es preciso concretar estos dos ámbitos de la intervención penal, en orden a establecer las divergencias que en torno a ello podemos encontrar en nuestra legislación y que se ha ido señalando en toda la extensión de este estudio.
