Abstract

Este trabajo consiste en el estudio de uno de los nuevos tipos delictivos introducidos en el CP mediante la reforma operada por la Ley Orgánica 4/2022, de 12 de abril. Se trata de una nueva figura que castiga el acoso producido a mujeres que acuden a las clínicas abortivas. Este delito se recoge en el artículo 172 quáter de nuestro Código para garantizar la seguridad de las mujeres que acuden a dichas clínicas. Por tanto, durante esta investigación procederemos a un análisis del tipo, proporcionando la opinión doctrinal y jurisprudencial, siempre que nos sea posible. Además de estudiar, su posible colisión con derechos como la libertad de expresión, libertad ideológica o religiosa, entre otras.

This work consists of the study of the new type of crime included in Organic Law 4/2022, of April 12, 2022, amending Organic Law 10/1995, of November 23, of the Penal Code. A new figure introduced in our Penal Code, which punishes the harassment of women who go to abortion clinics. This offence is defined in article 172 quarter of our Code to ensure the safety of women who come to these clinics. Therefore, during this investigation we will proceed to carry out an analysis of the type, providing whenever possible, the doctrinal and jurisprudential opinion. In addition to studying, its possible collision with rights such as freedom of expression, ideological or religious freedom, among others.
