Abstract

El contrato de arrendamiento de bienes inmuebles, especialmente cuando se trata de viviendas, se presenta en España como una opción secundaria o residual respecto a la propiedad urbana. La legislación arrendaticia española no ha ignorado esta tendencia en las últimas décadas y consciente de esta situación, las sucesivas reformas de la Ley de Arrendamientos Urbanos han pretendido, entre otros objetivos, nivelar el número de arrendamientos urbanos de viviendas frente a la propiedad de la misma. Estos constantes cambios legislativos no ayudan precisamente a dotar de seguridad jurídica y estabilidad al mercado arrendaticio con el objetivo de alcanzar la finalidad perseguida. El sistema hipotecario español se presenta como una herramienta útil para dotar de seguridad jurídica al mercado inmobiliario arrendaticio urbano a través de los efectos que proporciona la inscripción registral y la publicidad derivada de la misma. A pesar de ello, el legislador tradicionalmente, a la hora de regular el arrendamiento urbano, no tuvo en consideración los principios hipotecarios del sistema registral español, encontrándonos una legislación arrendaticia urbana tradicionalmente alejada de la fe pública registral. En el presente estudio se trata de abordar la relación existente entre los arrendamientos urbanos y el Registro de la propiedad en tiempos recientes, planteando propuestas concretas que pueden resultar de gran utilidad al legislador y a los operadores jurídicos.
