Abstract

El discurso de odio hace referencia a factores de identidad reales, supuestos o imputados de un individuo o grupo en un sentido amplio; es decir, puede referirse a su religión, etnia, nacionalidad, raza, color, ascendencia o el género, pero también a cualquier característica que transmita identidad como el idioma, el origen económico o social o el estado de salud, entre muchas otras. El auge de odio en Internet plantea retos sin precedentes para las sociedades del Siglo XXI. La incitación al odio online puede producirse y distribuirse fácilmente sin esfuerzo e incluso de forma anónima, con posibilidad de llegar a una audiencia global y diversa en tiempo real. Por no hablar de que los contenidos online permanecen en la red y pueden resurgir y ganar popularidad con el paso del tiempo. Ello ha provocado que algunos Estados responsabilicen a las empresas que gestionan el flujo de informaciones y opiniones desde Internet de la moderación y la eliminación de los contenidos que consideran que infringen su normativa, lo que suscita la preocupación por la limitación de la libertad de expresión frente a la protección de los derechos de terceros. Por ello, la comprensión y el análisis que esté haciendo sobre esta cuestión el Tribunal Europeo de Derechos Humanos (en adelante el TEDH) es fundamental para dar forma a una respuesta efectiva, armonizada y viable para todos los Estados Miembros del Consejo de Europa.

Hate speech refers to actual, perceived or imputed identity factors of an individual or group in a broad sense; that is, it can refer to their religion, ethnicity, nationality, race, colour, descent or gender, but also to any identity-conveying characteristic such as language, economic or social origin or health status, among many others. The rise of hate on the Internet poses unprecedented challenges for 21st Century societies. Online hate speech can easily be produced and distributed effortlessly and even anonymously, with the potential to reach a global and diverse audience in real time. Not to mention that online content remains online and can resurface and gain popularity over time. This has led some states to make companies that manage the flow of information and opinions from the Internet responsible for moderating and removing content that they consider to infringe their regulations, raising concerns about the limitation of freedom of expression versus the protection of third party rights. Therefore, the ongoing understanding and analysis of this issue by the European Court of Human Rights (hereinafter the ECtHR) is essential to shape an effective, harmonized and workable response for all Council of Europe Member States.
