Novedades y retos actuales del patrimonio natural

Abstract

Hemos analizado las principales novedades jurídicas y los retos que afronta la política de protección del patrimonio natural, en España y en la UE. Se estudian las políticas de mitigación y de adaptación que afectan al patrimonio natural. Entre las primeras, el secuestro de CO2 (sumideros naturales). Entre las segundas, la necesaria compatibilización de los recursos naturales con la instalación de parques eólicos y fotovoltaicos, como consecuencia de las mayores demandas comunitarias, que han culminado con la exigencia de neutralidad climática en la LCCTE y en el Reglamento UE 2021/1119. Finalmente, estudiamos el auge del pago por los servicios ecosistémicos: bancos de conservación de la naturaleza y acuerdos de custodia del territorio.

We have analyzed the main legal developments and the challenges faced by the natural heritage protection policy in Spain and in the EU. Mitigation and adaptation policies that emerge to the natural heritage are discussed. Among the first, the sequestration of CO2 (natural sinks). Among the second, the need to make natural resources compatible with the installation of wind and photovoltaic parks, as a consequence of the greater community demands, which have culminated in the demand for climate neutrality in the LCCTE and in the EU Regulation 2021/1119. Finally, payment for ecosystem services is studied: conservation banks and agreements for the custody of the territory.
