The importance of patria potestas (paternal power) that is emphasized by the word of familia (Roman family) by pointing out it in essence and also Roman family’s being a keystone in the early establishment of Roman government (civitas) had a main influence on our elaborating this study with the topic “Patria potestas in Roman Family Law”. In this study, first of all, after releasing general information about Roman family and defining patria potestas, the institution of kinship in Roman law is analysed. Afterwards, familia proprio iure in Roman law is defined, ant its content is designated. Subsequently, under the topic of “Familia Communi Iure in Roman Law and Patria Potestas “, content of familia communi iure is explained, enforcement of patria potestas is analysed, founding patria potestas on childeren of the family (filius familias) by registering of births, adoptio, adrogatio, legitimatio is asserted, founding manus on women is considered and finally ending of patria potestas is analysed.

Patria potestas’ın (baba hakimiyetinin), familia (Roma ailesi) kelimesi ile asıl işaret edilmek istenen oluşuyla vurgulanan önemi ve Roma ailesinin (familia’nın), devletin (civitas’ın) ilk oluşumundaki temel taşı oluşu, “Roma Aile Hukukunda Patria Potestas” başlıklı bu çalışmayı meydana getirmemizde etkili olmuştur. Çalışmada önce Roma ailesi (familia) hakkında genel bilgi verilmiş ve patria potestas’ın tanımı yapılmış, sonra Roma’da hısımlık kurumu incelenmiştir. Sonra, Roma’da dar anlamda ailenin (familia proprio iure’nin) tanımı yapılmış ve kapsamı belirtilmiştir. Daha sonra “Roma’da Geniş Anlamda Aile (Familia Communi Iure) ve Patria Potestas” başlığı altında geniş anlamda ailenin kapsamı açıklanmış, Patria Potestas’ın hükmü incelenmiş, aile evlatları (filius familias) üzerinde doğumla, adoptio, adrogatio, legitimatio yoluyla patria potestas’ın kuruluşu açıklanmış, kadınlar üzerinde manus’un kuruluşu ele alınmış ve patria potestas’ın sona erme halleri incelenip çalışmaya son verilmiştir.
