Abstract

Speluncean Gezginler davası Lon. L. Fullar tarafından kaleme alınmış farazi bir davadır. Bu dava herhangi bir davada karşılaşılabilecek birçok sorunu içinde barındırmakta ve en önemlisi, görüşlerini belirten hakimler vasıtasıyla hukuk teorilerinin uygulamada ne denli önemli olduğunu göstermektedir. Bu nedenle dava özellikle akademisyenler ve hukuk öğrencileri açısından hukuk alanında mevcut teorik ve Pratik sorunları tartışabilmek açısından mükemmel bir örnek oluşturmaktadır. Bu makale ile amacım söz konusu davaya ilişkin olguları ve farklı perspektiflerden olayı değerlendiren hakimlerin ileri sürdüklerini ortaya koymak suretiyle okuyucuyu birbiriyle çatışan farklı hukuk akımları zorlu bir yolculuğa çıkarmaktır. The case of the Speluncean Explorers is a hypothetical case which was created by Lon L. Fuller. This case includes many issue that can be encountered in any legal case and most importantly it shqws the impact of the legal theories on judicial judges. Therefore it is a great example for legal scholars and law students to discuss a great variety of theoretical and practical matters in law. My Pupose here is to describe the facts and examine the opinions in the Case of the Speluncean Explorers which explored the facts from the perspectives of conflicting legal theories, in order to take readers on a challenging journey into fundamental theories of law.
