Abstract

La existencia de un principio general de responsabilidad civil por culpa parece ser un dogma incontrovertible en el derecho colombiano; sin embargo, la evolución que han presentado las normas de indemnización de perjuicios en nuestro país ha conducido a una proliferación de regímenes de responsabilidad que excluyen la culpa como condición de aplicación, tanto en materia extracontractual como contractual. Así las cosas, la teoría que parte de este supuesto 'principio general' no parece corresponder a la realidad actual de la normativa colombiana. En este orden de ideas, el autor intenta controvertir la existencia de un verdadero principio general de responsabilidad civil por culpa, y poner de manifiesto las contradicciones en las que han incurrido la doctrina y jurisprudencia nacionales sobre la materia.

The existence of a general principle of civil responsibility by fault seems to be an incontrovertible dogma in the Colombian law; nonetheless, the evolution that has taken place on the norms of perjuries-indemnities has led to a proliferation of responsibility regimes that exclude the fault as a complying condition in the contractual as well as the extra-contractual issues. Thus, the theory that stems from this supposedly 'general principle' does not seem to correspond to the current reality of the Colombian normative. In this order of ideas, the author aims at making a controversy with the existence of a true general principle of civil responsibility by fault and expounding the contradictions committed by the national doctrine and jurisprudence over this issue.
