Actualmente el debate de los derechos económicos, sociales y culturales ha pretendido construir desde diferentes perspectivas una explicación plausible para lograr su efectividad a través de la reglamentación de estos derechos en las políticas públicas del Estado o a través de la judicialización de los mismos. Frente a este último tema se encuentra con un abrumador panorama surgido de la carencia de una acción judicial expresamente consagrada en la Constitución que permita un claro amparo. El presente escrito pretende abordar esta problemática desde la historia, concepto y estructura de los derechos económicos sociales y culturales, con el fin de demostrar que tales derechos carecen de protección por un asunto puramente formal y que deberán ser considerados como derechos fundamentales de obligatorio cumplimiento y protección por todos los poderes del Estado y protegidos judicialmente como derechos fundamentales.
Currently, the debate over economic, social and cultural rights seeks to construct, from different perspectives, a plausible explanation to achieve their effectiveness across the regulation of these rights, or across their judicialization. This articles seeks to approach this subject from the viewpoint of the history, concept and structure of these rights. The intention is to demonstrate that these rights fail to protect because they are regarded as purely formal matters. Rather, they ought to be considered as fundamental rights, which oblige compliance and protection by all State and judicial powers.
