La co-progettazione, introdotta dal Codice del Terzo settore, s’inserisce in un contesto di amministrazione condivisa in cui privato e pubblica amministrazione collaborano in vista della comune tutela di interessi generali. Tale istituto è caratterizzato da indeterminatezza dovuta al fatto che il dato normativo non indica il procedimento che le amministrazioni devono seguire ma solamente i principi e gli obiettivi da realizzare. A ciò si aggiunge l’interpretazione fornita dal giudice amministrativo che ha paventato il potenziale contrasto dell’art. 55, commi 3 e 4, d.lgs. n. 117/2017, con il Codice dei contratti pubblici e con il principio della libera concorrenza. Il presente lavoro, pertanto, si pone l’intento di superare le criticità applicative dell’art. 55, commi 3 e 4, d.lgs. n. 117/2017, cercando di fornire una definizione della sua natura che sia compatibile con le direttive 2014/23/UE e 2014/24/UE.

Co-planning, introduced by the Third sector Code, is part of a shared administration context in which private and public administration work together in view of the common protection of general interests. This institute is characterized by indeterminacy because the law does not indicate the procedure that the administrations must follow but only the principles and objectives to be achieved. Added to this, there is an interpretation provided by the administrative judge who affirmed the potential conflict of art. 55, paragraphs 3 and 4, legislative decree n. 117/2017, with the Code of public procurement and with the principle of free competition. This work aims to overcome the application criticalities of art. 55, paragraphs 3 and 4, legislative decree n. 117/2017, trying to provide a definition of its juridical nature that is compatible with directives 2014/23/EU and 2014/24/EU.
