Abstract

Il contributo dà conto delle principali tesi dell’ermeneutica giuridica – composito movimento nato in Germania nella seconda metà del Novecento ed estesosi in altre aree culturali – che pone attenzione alle implicazioni sottese alle caratteristiche del momento interpretativo come aspetto essenziale della giuridicità. Le idee centrali del movimento ermeneutico riguardano la critica al legalismo giuridico e al sillogismo giudiziale; la presa d’atto della correlazione tra norma e fatto nel processo di concretizzazione del diritto; il legame costitutivo tra interpretazione e applicazione; la relazione tra interprete e testo in quanto dato linguisticamente trasmesso; la rilevanza della precomprensione come condizione di conoscenza del problema da risolvere giuridicamente che rinvia alla valutazione anticipata, da vagliare criticamente, del risultato ritenuto congruo; i controlli di razionalità delle decisioni interpretative. Viene sottolineata altresì l’importanza della prospettiva ermeneutica nell’ambito delle odierne teorie del diritto e del ragionamento giuridico.
