Abstract

La recidiva reiterata, di cui all'art. 99, comma 4, c.p., opera quale circostanza aggravante, inerente la persona del colpevole, facoltativa, nel senso che è consentito al giudice escluderla ove non la ritenga in concreto espressione di maggior colpevolezza o pericolosità sociale del reo. Dall'esclusione della recidiva deriva l'elisione dei suoi effetti non solo sulla determinazione della pena, ma anche sugli ulteriori aspetti commisurativi della sanzione costituiti dal divieto del giudizio di prevalenza delle circostanze attenuanti di cui all'art. 69, comma 4, c.p. dal limite minimo di aumento della pena per il cumulo formale, di cui all'art. 81, comma 4, c.p., dall'inibizione all'accesso al "patteggiamento allargato" ed alla relativa riduzione premiale di cui all'art. 444, comma 1 bis, c.p.p.
