Abstract

Il lavoro considera il rapporto tra dittatura e popolo in quanto utile a comprendere aspetti essenziali dell’intero sistema costituzionale romano, soprattutto per quanto concerne la concezione del potere del magistrato e le modalità dell’agire del popolo. La disattenzione della dottrina per tale tematica dipende in larga parte dal fatto che la dittatura ha assunto, spe-cialmente a partire dalla Rivoluzione Francese, una connotazione negativa, fino a essere erroneamente confusa con la tirannide, generandosi così una certa diffidenza nella dottrina. Nel dibattito politico e giuridico, in età mo-derna e contemporanea, sono presenti, invece, riconoscimenti del valore positivo di questa stessa magistratura. Riconoscimenti che corrispondono al fatto che la dittatura era di solito propugnata e accolta a Roma come so-luzione equilibrata e corrispondente ai valori della res publica, pure se all’interno dei conflitti tra i «partiti politici».
