Abstract

The State is a modern juridico-political construct that emerged with the centralization and institutionalization of power following the decline of feudal and local dominations. It embodies a sovereign and unitary organization that exercises legitimate coercion and taxation to maintain order and stability. From Bodin and Hobbes to Locke, Kant, and Kelsen, the evolution of State theory reflects the tension between absolute sovereignty and the limitation of power by law and natural rights. The modern State transitioned from the absolutist model, where law was an expression of sovereign will, to the constitutional and social State, founded on legality, individual rights, and welfare principles. Contemporary developments, such as globalization, supranational governance, and the resurgence of social and regional powers, challenge the State’s unity, independence, and capacity to govern. The current “crisis of the State” thus represents a structural transformation of sovereignty within a multilevel and post-national legal order.

Lo Stato è un costrutto giuspolitico moderno, nato con la razionalizzazione e centralizzazione del potere seguite al tramonto delle dominazioni feudali e locali. Esso si configura come un’organizzazione unitaria e sovrana che esercita coercizione e fiscalità legittime per garantire ordine e stabilità. Dalle teorie di Bodin e Hobbes a quelle di Locke, Kant e Kelsen, l’evoluzione del concetto di Stato riflette il conflitto tra sovranità assoluta e limitazione del potere mediante il diritto e i diritti naturali. Dallo Stato assoluto si giunge allo Stato costituzionale e sociale, fondato sulla legalità, sui diritti individuali e sui principi del welfare. Le trasformazioni contemporanee – globalizzazione, governance sovranazionale e riaffermazione di poteri sociali e territoriali – mettono in crisi l’unità, l’indipendenza e la capacità di governo dello Stato, delineando una “crisi dello Stato” intesa come trasformazione strutturale della sovranità nell’ordine giuridico multilivello e post-nazionale.
