The essay examines the progressive hegemonic role of the Court of Cassation and, in contrast, the corresponding marginalization of the Attorney General despite the fact that, by Constitution, the same Agent is fully intimate with the Court itself. Therefore, the text proposes the involvement of the Attorney General in the selection, based on art. 380-bis c.p.c., of inadmissible or manifestly unfounded appeals so as to ensure a new duality at the apex of the Judiciary.
