The paper traces the path of ‘Clinical Self-Regulation’ in Italy, which in recent years has been placed at the forefront of legal reforms concerning criminal liability of healthcare professionals. After framing Clinical Practice Guidelines, best practices, and protocols within the paradigm of ‘medical self-regulation’ and its categories, its evolution and incorporation into the Criminal Justice System are analysed through the influences of jurisprudence, legislation, and doctrine. In conclusion, following an examination of the effects of this public-private partnership, the A. speculates the reasons for a potential future transformation of the importance attributed to this type of reflexive norms within the penal system.
Il contributo ripercorre la parabola della self-regulation medico-chirurgica in Italia, che negli ultimi anni è stata posta al centro delle riforme in tema di responsabilità medica. Dopo aver inquadrato le linee guida medico chirurgiche, le buone prassi e i protocolli nel paradigma e nelle categorie della c.d. ‘autonormazione medica’, se ne analizza l’evoluzione e il recepimento nell’ordinamento per il tramite dei formanti giurisprudenziale, legislativo e dottrinale. In conclusione, dopo aver esaminato gli effetti di questa partnership pubblico-privata, si ipotizzano le ragioni della futura probabile trasformazione del ruolo accordato a questa tipologia di fonti riflessive nel sistema penale.
