Terzo settore e Costituzione

Abstract

Il volume Terzo settore e Costituzione intende indagare, in termini costituzionali, il complessivo tema della definizione del perimetro normativo degli enti e delle attività del c.d. Terzo settore, i caratteri propri della legislazione promozionale che lo interessa ed i meccanismi di controllo che lo riguardano, sia in chiave generale sia dopo la riforma approvata in Italia nel 2017 nella XVII legislatura. Il Terzo settore non è, certamente, un fenomeno nuovo dal punto di vista sociale, politico ed economico in Italia, sebbene siano state utilizzate molte differenti denominazioni per indicarlo; più recente, invece, è la sua rilevanza sul piano giuridico e la sua complessiva sistemazione all’interno di un codice di settore. La ricerca prova ad affrontare i numerosi nodi costituzionali ancora aperti, tenendo conto dell’esigenza di aprire una prospettiva di dialogo fra ordinamento interno ed ordinamento dell’Unione Europea e delle sperimentazioni che si registrano a livello locale e regionale.
