O direito do trabalho da crise

Abstract

L’autore si propone di analizzare le misure reattive adottate dal Governo Monti a fronte dell’attuale crisi economica, la quale – anche alla luce delle indicazioni formulate in tal senso da parte dell’Unione europea - ha imposto una rivisitazione delle regole che presiedono il mercato del lavoro, alla ricerca di un assetto equilibrato, tra le esigenze di tutela della persona del lavoratore e le esigenze di contenimento del costo del lavoro, anche in relazione alla capacità dell’Italia – pur in una realtà globalizzata - di saper attrarre e/o mantenere gli investimenti industriali, nazionali e stranieri. Il contributo si concentra, in particolare, sulla rimodellazione dell’art. 18 dello Statuto dei lavoratori e sulla nuova disciplina del licenziamento illegittimo, mettendo in evidenza la mutata fisionomia della stabilità reale, rispetto al previgente regime.
