Il lavoro straordinario dalle politiche di divieto al "realismo sociale"

Abstract

L’articolo contiene il commento dell’art. 5 del d.lgs. n. 66/2008 in materia di lavoro straordinario. Esso si sofferma inizialmente sull’evoluzione storica della disciplina limitativa dell’istituto, in particolare concentrandosi sull’evoluzione del rapporto tra legge e contrattazione collettiva nella determinazione della soglia normale dell’orario, al cui spirare decorre lo straordinario. In seguito, lo sguardo si concentra sulla disciplina generale dello straordinario attualmente in vigore. Vengono esaminate le norme in tema di: limiti quantitativi e volontarietà dello straordinario; limiti tipologici; obblighi procedurali; le esclusione soggettive e oggettive dal regime del lavoro straordinario; la disciplina previdenziale disincentivante; il trattamento retributivo dello straordinario; l’istituto della banca delle ore.
