Abstract

La locazione finanziaria (o leasing) è uno schema contrattuale atipico, derivato dall’esperienza anglosassone, che presenta numerose varianti. La locazione finanziaria assolve, in linea di principio, una funzione di finanziamento per l’acquisto della disponibilità immediata di un bene: l’utilizzatore non riceva alcuna erogazione di danaro, ma consegue l’utilità connessa all’immediato godimento di un bene, impegnandosi a corrispondere un canone periodico, con la facoltà, al termine del rapporto, di restituirlo o acquistarlo. Il contributo ricostruisce la disciplina e le caratteristiche del contratto di leasing, alla luce della prassi e dei principali orientamenti giurisprudenziali.
