Abstract

Molte delle aporie dell’opera di Kelsen individuate da Luigi Ferrajoli nel suo libro La logica del diritto (Laterza, 2016) in buona sostanza coincidono con le tendenze al realismo giuridico del Kelsen americano e dell’ultimo Kelsen scettico e “irrazionalista”. Ma è discutibile che si tratti di vere aporie, cioè, secondo la definizione di Ferrajoli, di tesi erronee, incoerenti, imprecise e poco utili per la teoria del diritto. Nel saggio, intendo appunto mostrare che alcune pretese aporie non sono interne alla teoria di Kelsen e corrispondono a scelte consapevoli, di natura metodologica, teorica e normativa, che distinguono Kelsen da Ferrajoli e che paiono difendibili. Inoltre, sostengo che la critica di Ferrajoli fraintende le motivazioni di fondo della teoria pura – in particolare, il ruolo dell’unità della conoscenza giuridica nella teoria di Kelsen – ed è quindi, sotto questo aspetto, poco generosa con Kelsen.
