Abstract

A distanza di oltre venti anni dall’entrata in vigore della l. 7 marzo 1996, n. 108 («Disposizioni in materia di usura») è ancora fortemente discusso quali voci di costo rientrino nel sindacato antiusura. In particolare, il volume indaga la rilevanza usuraria dei c.d. oneri eventuali, ossia gli oneri economici che il prenditore deve all’intermediario non già per effetto della sola conclusione del contratto, ma al verificarsi – nel corso di svolgimento del rapporto – di fatti futuri ed incerti. A questo riguardo, il dibattito dottrinale e giurisprudenziale è senz’altro prevalentemente attestato sugli interessi moratori, mentre sensibilmente meno indagate, tanto in letteratura quanto, ed in specie, in seno alla giurisprudenza di legittimità, la penale da ritardo/inadempimento e la commissione di estinzione anticipata; ben nota, invece, l’evoluzione amministrativa, normativa e giurisprudenziale che ha interessato la commissione di massimo scoperto, pur di recente interessata da un pronunciamento delle Sezioni Unite potenzialmente in grado di influenzare la querelle anche rispetto agli altri costi eventuali, primi fra tutti gli interessi moratori. Pur non trascurando le diversità strutturali e/o funzionali intercorrenti tra l’una e l’altra species, l’autrice predilige un approccio che miri a ricondurle a una considerazione il più possibile unitaria, sotto il profilo dei presupposti di integrazione dell’eventuale usurarietà, dei correlativi metodi di calcolo e delle conseguenze rimediali.
