Abstract

Haksız rekabet TTK'nın yanı sıra BK'da da düzenleme altına alınmıştır. TTK'da "aldatıcı hareket veya hüsnüniyet kaidelerine aykırı sair suretlerle iktisadi rekabetin her türlü suiistimali" şeklinde tanımlanan haksız rekabetin sadece ticari işlerde değil, iktisadi rekabetin olduğu her yerde uygulanacağı anlaşılmaktadır. Bu nedenle bizce BK'nın uygulama alanı bulunmamaktadır ve ilgili hükümlerinin kaldırılması gerekmektedir. Ancak yeni Boçlar Kanunu Tasarısı'nın bu maddeyi korumakta olduğu da görülmektedir.
