Abstract

Bu makalede Ceza Muhakemesi Kanunu'nun 223'ncü maddesinde düzenlenen hüküm ve suç genel teorisi ile ilişkisi üzerinde kısaca durulmuştur. Ceza hukukunda hukuki niteliği tartışmalı olan birçok hukuki müessesenin niteliği kanunla belirlenmiştir. Madde muhakeme hukukunun yanı sıra maddi ceza hukukunu da yakından ilgilendirmektedir. Bu sebeple maddenin maddi ceza hukuku ile ilgisi üzerinde de durulmuştur
