Abstract

Il saggio cerca di rispondere alla domanda su come Calamadrei, che fin da subito si schierò contro il fascismo, abbia reagito di fronte alle leggi razziali, egli che era un grande giurista. Per rispondere alla domanda sulla posizione assunta da Calamandrei di fronte all’approvazione e soprattutto all’attuazione delle leggi razziali, l’A. si sofferma su quattro punti: a) alcune brevi considerazioni sulle leggi razziali e il ceto dei giuristi; b) una analisi approfondita della conferenza tenuta da Calamandrei il 21 gennaio 1940 alla federazione universitaria cattolici italiani (FUCI); c) una indagine sui testi più intimi (il diario e le lettere), dove emerge il suo rifiuto delle leggi razziali; d) infine, alcune riflessioni sul percorso di Calamandrei verso la legalità costituzionale e il suo contributo alla codificazione delle “leggi dell’umanità” nella Costituzione, tra cui il testo dell’art. 3, in cui si afferma al primo comma l’uguaglianza di fronte alla legge senza distinzione di razza

The essay aims to answer the question about how Calamandrei, who took side against fascism from the beginning, reacted to the racial laws, since he was a great jurist. In order to answer the question on the position taken by Calamandrei regarding the approval and especially the implementation of the racial laws, the Author lingers on four points: a) some brief considerations on the racial laws and the jurists’ class; b) a thorough analysis of the conference held by Calamandrei on 21st January 1940 at the Italian catholic university federation (FUCI); c) a research on the most intimate works (the diary and the letters), where his refusal for the racial laws appears; d) lastly, some reflections on the Calamandrei journey to constitutional legality and his contribution to the “humanity laws” codification inside the Constitution, among which is article 3, where the paragraph 1 thereof affirms equality before the law without any sort of racial discrimination
