Muamelat Fıkhında Kadın Farkı ve Günümüz Türk Hukuku Çerçevesinde Tahlili Bir Yaklaşım

Abstract

It is Islam that brings together women who have been subjected to bullying and deprived of her rights in the historical process with the position they deserve in the context of gender, gender, rights and duties. The idea of transactions, which concerns the issues of the Islamic Fiqh, which are within the scope of civil law status represents the legal field in which the difference between female and male beings emerges in the most obvious way depending on their rights and responsibilities. In many titles such as marriage, talaq, guardianship, alimony, mahr, martyrdom, inheritance, it is essential that women and men have a distribution of roles based on individual and social justice, and there is a special set of practices and privileges in favor of women in particular. It is also related to the orginality of the principles and procedures of Islamic Law, which can be ruled with a positive shift/distinction in favor of women and the protection of justice between the sexes. This study, which aims to reveal the difference between men and women which arise in private practices, with their views and evidences in terms of Islamic Law schools, has been organized to analyze how the same legal issues are evaluated within the scope of decree laws.

Tarihî vetirede ezilen, zorbalığa mâruz bırakılan ve haklarından mahrum edilen kadını cinsiyet, toplumsal cinsiyet, hak ve ödevler bağlamında hak ettiği konumuyla buluşturan İslâm’dır. İslâm Fıkhı’nın el-ahvâlü’ş-şahsiyye kapsamında kalan konularını ilgilendiren muâmelât, hak ve sorumluluklarına bağlı olarak kadın ve erkek varlıkları arasındaki farkın en bâriz şekilde ortaya çıktığı hukukî alanı temsil etmektedir. Nikâh, talâk, velâyet, nafaka, mehir, şahitlik, miras gibi pek çok başlıkta kadın-erkek arasında bireysel ve sosyal adâlet temelli bir rol dağılımı esas olup, bilhassa kadın lehine özel bir takım uygulama ve ayrıcalıklar söz konusudur. Hem kadın lehine pozitif kayırma/ayrım ile hükmedilip hem de cinsler arasında adâletin korunabilmesi İslâm hukukunun ilke ve prosedürlerinin orjinalitesiyle ilgilidir. Muâmelât fıkhını ilgilendiren konu başlıkları ile özel uygulamalarda ortaya çıkan kadın-erkek farkını İslâm hukuk doktrinleri bakımından görüş ve delilleriyle ortaya koymayı amaçlayan bu çalışma, aynı hukukî konuların mer’î kanunlar kapsamında nasıl değerlendirildiğini de tahlil etmeye yönelik düzenlenmiştir.
