La crisis de la justicia en la sociedad posliberal

Abstract

Parece universal el sentimiento de injusticia, la crisis de la justicia, pero no se ha sabido encontrar una explicación que nos auxilie a restablecerla y vivir en una sociedad justa. Sostendré que la presente crisis de la justicia es metafísica y también ética. Metafísica porque, a fuerza de separar lo ético de lo moral y ambos de lo político, la justicia se desvincula del bien y del derecho, dejando lo bueno y lo justo como órdenes aislados, extraños, que a lo sumo se componen en la conciencia individual o en la ideología. Por lo mismo sobreviene la crisis ética, ya que re c l u i d o s el bien y la justicia en el precinto de lo privado, se postula la const rucción de una sociedad justa sin atender a la justicia y aun con individuos injustos. Los vicios privados devienen virtudes públicas, al punto que el Estado puede implantarse en «una raza de demonios» con tal que sean racionales. El irremediable caos o conflicto interindividual es arreglado racionalmente por un diseño institucional que se postula estable no obstante las preferencias individuales y las tendencias egoístas de la naturaleza humana. La sentencia de Kant está en los cimientos de nuestras sociedades injustas: “No es la moralidad la que condiciona una buena constitución, sino al contrario: una buena constitución dará como resultado la formación moral del pueblo”
