Este trabajo implica un acercamiento a la retórica clásica tal como surge de la programática formulada por Aristóteles. Nos interrogamos acerca de cómo se construye la dimensión pasional en un corpus conformado por expedientes judiciales. Género, pathos y auditorio son las nociones medulares del planteo pues se trata de constructos que se superponen y conviven en este tipo de documentos cuya especificidad radica en la lucha por la imposición de un punto de vista ante un auditorio privilegiado: el juez. Proponemos analizar el corpus a la luz de estos conceptos avalados en la conjetura de que es la esfera de la praxis la que determina la emergencia de determinadas pasiones y no de otras.
This paper involves an approach to classical rhetoric as derived from the program formulated by Aristotle. We wonder how is the passionate dimension constructed in a corpus consisting of court records. Gender, pathos and audience are the core notions because they coexist and overlap each other in this type of documents whose specificity is the fight for the imposition of a particular point of view to an important audience: the judge. We propose to analyze the corpus in the light of these concepts endorsed in the conjecture that is the praxis which determines the emergence of certain passions and not others.
