El propósito de este trabajo es revisar, desde las renovadas propuestas historiográficas, el concepto de propiedad y los diversos derechos que les asistían a los sectores propietarios de tierras rurales de Tucumán, durante el período colonial tardío. El objetivo se complementa con la posibilidad de analizar en qué medida el ejercicio y transferencia de esos derechos incidieron en la fragmentación e indivisión de las tierras del paisaje agrario tucumano.Para ello se define la posición teórica adoptada, se analizan los derechos sobre la propiedad vigentes en la tradición jurídica y en las prácticas, y se estudian algunos casos tratados por la justicia local.
The purpose of this paper is to review, from the renewed historiographical proposals, the concept of property rights and the various sectors attended them rural landowners of Tucuman during the late colonial period. The goal is complemented by the possibility to analyze to what extent the exercise and transfer of rights affected the fragmentation and undivided land agrarian landscape Tucuman. For this a theoretical position taken is defined, and property rights current in the legal traditions and practices are analyzed. Also some cases investigated by the local justice are studied.
