Abstract

En Argentina la prisión preventiva es un eslabón clave para comprender su demografía carcelaria. Esto se observa particularmente en la provincia de Buenos Aires, en la cual existe el mayor número de encarcelados del país y, además, los porcentajes más altos de presos sin condena. En este artículo mencionaremos algunos componentes que dentro de la justicia penal parecen favorecer el uso de dicha prisión preventiva. Para ello vamos a presentar una serie de testimonios de distintos actores judiciales, junto con los aportes teóricos que van de la sociología crítica de Pierre Bourdieu hasta la sociología de la crítica ligada a Luc Boltanski, con los cuales intentaremos especificar las razones de la utilización actual de la medida cautelar en cuestión.

In Argentina, preventive detention is a key link to understand your prison demography. This is particularly observed in the province of Buenos Aires, where the largest number of prisoners in the country, and also the highest percentage of unconvicted prisoners. This article will mention some components within the criminal justice seem to favor the use of such preventive detention. We are going to present a series of testimonies of various judicial actors beside the theoretical contributions ranging from critical sociology of Pierre Bourdieu to sociology of criticism linked to Luc Boltanski, with which we will try to specify the reasons for the current use of the injunction in question.
