Estrategias retóricas y cultura jurídica en el Buenos Aires virreinal: los defensores de pobres en procesos criminales (1776-1809)

Abstract

El presente trabajo se propone indagar en las prácticas que desplegaron los Defensores de pobres del Cabildo de Buenos Aires en el ejercicio de una de sus múltiples funciones: el patrocinio de reos procesados penalmente. Primero delinearemos un perfil social de los sujetos asistidos por los defensores y luego nuestro objetivo primordial será dar cuenta de las modalidades que asumió el contacto entre estos regidores y sus defendidos. Por último analizaremos las estrategias retóricas utilizadas y sus resultados en los litigios bajo estudio. Creemos que dicha indagación puede iluminar aspectos poco conocidos de la cultura jurídica de la época, y al mismo tiempo darnos una imagen más acabada de la justicia penal del Antiguo Régimen practicada en la capital del Virreinato del Río de la Plata.

This paper aims to look into the performance of the Defensores de pobres of the Council of Buenos Aires in the exercise on one of its multiple functions: the patronage of prisoners criminally prosecuted. First we will carry out a social profile of persons assisted by defenders and then our main objective will be to account for the contact between these members of the council and their clients. Finally we analyze the rhetorical strategies used and their results in the litigations under study. We believe that such an inquiry can illuminate little-known aspects of the legal culture of the time, and give us a more complete picture of the criminal justice system practised in the ancient capital of the Viceroyalty of the Río de la Plata.
