Abstract

De acuerdo con la Ley argentina de ejecución penal vigente 24660/96 y sus modificatorias, el período de "libertad condicional" es la última fase de una sentencia condenatoria, cuando ya se han cumplido las dos terceras partes en la cárcel y se cumple en forma positiva con determinados requisitos. El objetivo de este trabajo es mostrar que la libertad condicional no es solo un procedimiento administrativo, donde si no se cumplen algunas de las exigencias se vuelve a la cárcel, para concluir, otra vez en reclusión, la sentencia dictada en su momento. También, desde una visión antropológica, se puede considerar este período como un proceso de transición, en donde se juegan factores que tienen que ver, además de los usualmente nombrados por la literatura científica (vivienda, trabajo, reunificación familiar, actitudes comunitarias), con una necesidad de alcanzar una ciudadanía plena, en un intento de reconfigurar una identidad dañada. Se trata de una investigación cualitativa realizada en una provincia de la Patagonia norte, de Argentina, con métodos etnográficos, entrevistas con profundidad e historias de vida.

De acordo com a lei argentina da execução penal vigente 24660/96 e suas modificações, o período da "liberdade condicional" é a última fase de uma sentença condenatória, quando dois terços do tempo na prisão têm sido cumpridos e é cumprido positivamente com determinadas exigências. O objetivo deste trabalho é mostrar que a liberdade condicional não é só um procedimento administrativo, onde se algumas exigências não foram cumpridas volta- se à prisão, para concluir, outra vez no aprisionamento, a sentença ditada no seu momento. Também, desde uma visão antropológica, este período pode-se considerar como um processo de transição, onde os fatores que estão em jogo estão relacionados com, além dos nomeado geralmente pela literatura científica (domicílio, trabalho, reunificação familiar, atitudes comunitárias), uma necessidade para alcançar uma cidadania total, em uma tentativa de reformar uma identidade estragada. É uma investigação qualitativa feita em uma província da Patagônia, no norte de Argentina, com métodos etnográficos, entrevistas com profundidade e histórias de vida.

According to the Argentinian Criminal Enforcement Law 24660/96 in force as amended, the "parole" or "probation" period is the last phase of a guilty verdict when the two third parts of a judgment of conviction have elapsed in jail and certain requisites have been met in a positive way. The objective of this work is to show that releasing prisoners on parole is not only an administrative procedure where if some of the requirements are not complied with, the prisoner will go straight back to jail in order to complete the original sentence behind bars. Likewise, from an anthropological point of view, this period may be deemed to be a transition process where additional factors, apart from those mentioned in the scientific literature (like housing, work, family reunification, community attitudes) have to do with the need to reach full citizenship in an attempt aimed at reconfiguring a damaged identity. This is a qualitative research carried out at a northern province of Argentina's Patagonia using ethnographic methods, in-depth interviews and real life stories.
