Rentas urbanas y alternativas de recuperación estatal: aproximaciones al caso de San Carlos de Bariloche y la participación municipal en la renta diferencial

Abstract

La intención de este artículo es aportar una recopilación no exhaustiva de algunas reformas e innovaciones jurídicas relativas al ordenamiento territorial que se sucedieron en Latinoamérica en estos últimos años. En particular, el interés se centra en preceptos constitucionales que habilitaron el diseño de instrumentos de política urbana legitimando la intervención del Estado en los mercados inmobiliarios y la potestad del derecho urbanístico en la planeación de las ciudades. Algunas de estas modificaciones en el plano jurídico podrían, en sus intersticios, desencadenar escenarios más propicios para brindar soluciones a las problemáticas urbanas que involucran estrechamente a la explotación del suelo y su uso. En relación a ello, se describirán una serie de experiencias vinculadas a la recuperación de la renta diferencial (plusvalías urbanas) en países latinoamericanos, incluyendo, también, algunas iniciativas promovidas por municipios argentinos a fin de ofrecer un acercamiento al estado de la cuestión en el país. Por último, se analizará con mayor detenimiento el caso de San Carlos de Bariloche. En orden a este propósito, se analizará la ordenanza 2080 de participación municipal en la renta diferencial del suelo sancionada a fines de 2010, utilizando, complementariamente, entrevistas realizadas a concejales que la aprobaron.

The intention of this article is to provide a non exhaustive collection of some legal reforms and innovations concerning territorial management that occurred in Latin America in recent years. In particular, the focus is on constitutional provisions that enabled the design of urban policy instruments legitimizing government intervention in housing markets and the power of urban law in city planning. Some of these changes in the legal might, in its interstices, trigger more favorable scenarios to provide solutions to urban problems involving closely to land use and usage. In relation to it, some experiences related to the recovery of differential rent (urban capital gains) in Latin American countries will be described, including, also, some initiatives promoted by Argentine municipalities to provide an approach to the state of affairs in the country. Finally, the case of San Carlos de Bariloche will be analyzed in more detail. In order to this purpose, ordinance 2080 of municipal participation in the differential rent enacted in late 2010 will be explored, using, in addition, interviews with councilors who approved it.
