Abstract

En este estudio se analiza la normativa existente en la Argentina en relación con la facultad de veto que tiene el presidente de la República y su papel en el proceso de formación de leyes. En trabajo comienza con las visiones que, desde la teoría política, alumbraron los contornos básicos del veto del Poder Ejecutivo en los Estados Unidos. Luego se pasa revista a los diferentes procedimientos que existen en los países latinoamericanos. Posteriormente se trata el diseño de la institución consagrado en la constitución argentina de 1853/60, los antecedentes legislativos y jurisprudenciales y las modificaciones practicadas con motivo de la reforma constitucional de 1994. En el estudio se reflexiona acerca del carácter de la institución y las vinculaciones entre el veto presidencial, la República y la Democracia. Asimismo se especula también sobre las posibilidades de una suerte de abuso del veto o “vetocracia” por parte del presidente

This study analyzes the existing regulations in Argentina regarding the veto power that the President of the Republic has and its role in the law making process. This paper begins with the visions from political theory, which lightened the foundations of the presidential veto in the United States. Then, it reviews the different Latin American veto procedures. The paper, especially, deals with the design of the veto institution enshrined in the Constitution of Argentina of 1853/60, the legislative precedents, the Jurisprudence and the amendments introduced by the constitutional reform of 1994. The study discusses the character of the institution and the linkages between the presidential veto, the Republic and Democracy. It also speculates about the possibilities of a kind of abuse of veto by the president or the so called “vetocracia”
