El Régimen penal juvenil: resistencias y tensiones en la implementación del paradigma de protección de derechos de niños/as y adolescentes

Abstract

El presente trabajo explora el viejo y nuevo paradigma de la legislación en niñez y adolescencia, a nivel local e internacional, respecto del pasaje del modelo tutelar al de los/as niños/as como sujetos/as de derecho. La intención es explorar sobre las diferentes fragmentaciones al interior de la población joven, específicamente de aquellas en conflicto con la ley penal. En Argentina, a pesar de este cambio fundamental, el régimen penal juvenil continúa reproduciendo prácticas tutelares que no se adaptan a las normativas constitucionales y estándares internacionales mínimos de derechos, además de reforzar el tratamiento punitivo de la cuestión penal juvenil. A su vez, se desarrollarán cuáles son las medidas alternativas a la privación de libertad para los/as menores en conflicto con la ley penal, en qué consisten, y cuál es su nivel de institucionalidad y eficacia. Para concluir, se esbozarán reflexiones sobre el desarrollo e inquietudes para continuar pensando.
