Abstract

Este trabajo analiza las visiones en pugna que forjaron el reconocimiento del derecho a la tierra en la Declaración sobre los Derechos de los Campesinos, aprobada por la Organización de las Naciones Unidas (ONU) en 2018. Se van a considerar los argumentos a favor y en contra. Sostendremos que este instrumento viene a proponer una concepción alternativa a la tierra como derecho patrimonial. Con sus aporías y desafíos, la declaración forma parte de un proceso continuo de expansión en el reconocimiento de los derechos humanos, los cuales se van re-formulando en relación con las luchas sociales. Desde una lectura conceptual sostenemos que el debate sobre el contenido y el alcance del derecho humano a la tierra tiene una incidencia central, porque enmarca la lucha campesina en una reivindicación que trasciende lo meramente sectorial e interpela a la sociedad en su conjunto sobre el modelo de desarrollo rural hegemónico basado en el agronegocio.

This paper analyzes the competing visions that forged the recognition of the right to land in the Declaration on the Rights of Peasants, approved by the United Nations (UN) in 2018. The arguments in favor and in against. We will maintain that this instrument proposes an alternative conception of land as a patrimonial right. With its aporias and challenges, the declaration is part of a continuous process of expansion in the recognition of human rights, which are being re-formulated in relation to social struggles. From a conceptual reading we maintain that the debate on the content and scope of the human right to land has a central impact, because it frames the peasant struggle in a demand that transcends the merely sectoral and challenges to society about the hegemonic rural development model based on agribusiness.
