Abstract

La miserabilidad de Manuela y María, las esclavas demandantes, y los alcances de esta condición, no solo estuvieron explicitadas en el inicio de la causa, sino que volvieron a emerger en repetidas ocasiones a lo largo de las fojas que fueron engrosando el expediente. Estas esclavas no fueron las únicas que dijeron ser miserables, reclamando en consecuencia ciertos beneficios procesales o buscando obtener un fallo acorde a sus pretensiones. En otras demandas protagonizadas por personas esclavizadas puede visualizarse la misma estrategia, en algunas ocasiones llegando a obtener sentencias favorables, a diferencia del caso descripto. ¿Porqué los esclavos y esclavas del Buenos Aires virreinal apelaban a la retórica de la miserabilidad? ¿Esta caracterización era una forma de autoidentificación solo de las personas esclavizadas o, por el contrario, gozaba de consenso entre otros actores sociales? ¿Qué consecuencias acarreaba esta peculiar caracterización en el ámbito de la justicia porteña en las postrimerías del período colonial? ¿El contenido y los alcances de dicha categoría legal estaban claramente delimitados o por el contrario eran materia de disputa? Estos son algunos de los interrogantes que nos proponemos responder en el siguiente capítulo.
