Abstract

En el presente trabajo analizo las relaciones laborales, de género y responsabilidades de cuidado, actualmente invisibles en los entornos judiciales, bajo el argumento de que hasta tanto no se visibilicen y adquieran relevancia pública no será posible transformar las actuales inequidades y discriminaciones persistentes, como tampoco podrán revisarse las falencias y problemas estructurales de la judicatura. Haciendo analogía con otros sectores ocupacionales, como el sector salud, en el cual la calidad del empleo condiciona la calidad de la atención, urge una revisión profunda de las lógicas imperantes en torno al empleo en la justicia. En concordancia se presentan algunos de los aspectos centrales que caracterizan al trabajo, remunerado y de cuidados a partir de los aportes centrales de la teoría feminista contemporánea, para concluir con recomendaciones que promuevan una agenda transformadora de las inequidades hoy existentes.

This paper analyzes labor relations, gender and care responsibilities, currently invisible in judicial environments, under the argument that until they become visible and acquire public relevance, it will not be possible to transform the current inequities and persistent discrimination, nor the shortcomings and structural problems of the judiciary may be reviewed. Making an analogy with other occupational sectors, such as the health sector, in which the quality of employment determines the quality of care, an in-depth review of the prevailing logic around employment in justice is urgently needed. Accordingly, some of the central aspects that characterize paid and care work are presented based on the central contributions of contemporary feminist theory, to conclude with recommendations that promote a transforming agenda of existing inequities today.
