El medio marino y el principio de cooperación: El caso de la Planta MOX y las medidas provisionales ante el Tribunal Internacional del Derecho del Mar

Abstract

El caso de la Planta de MOX es una controversia entre Irlanda y el Reino Unido relacionada con la autorización de este último para construir y operar una planta de combustible de óxido mixto (MOX) siendo sus desechos radioactivos transportados fuera del país mediante buques. Irlanda consideró la necesidad de tener una evaluación integral y actualizada de los impactos ambientales y que la operatoria de la planta podía ocasionar graves riesgos al ambiente marino. El caso fue planteado por Irlanda frente a tres jurisdicciones distintas: 1) conforme el procedimiento establecido en la Convención para la Protección del Ambiente Marino del Nordeste Atlántico (Convention for the Protection of the Marine Environment of the North-East Atlantic – OSPAR Convention), 2) de acuerdo al procedimiento establecido por la Convención de las Naciones Unidas sobre el Derecho del Mar de 1982; y 3) ante el Tribunal de Justicia de la Unión Europea, en Luxemburgo.El Tribunal Internacional para el Derecho del Mar consideró, en el caso, que el deber de cooperar es un principio fundamental en la prevención de la contaminación del medio marino y a partir de esta reflexión es que se presenta la propuesta de examen: analizar la naturaleza jurídica del principio de cooperación a la luz del derecho internacional del ambiente...
