La construcción de la verdad jurídica: prueba, interpretaciones y disputas en torno a la administración de inimputabilidad: El caso del "tirador serial".

Abstract

Uno de los objetivos del proceso penal es averiguar si determinados hechos han ocurrido o no y en qué términos y circunstancias. En este sentido, la "prueba" constituye un factor de conocimiento cuya función principal es establecer "la verdad de los hechos". Sin embargo, tanto el juzgamiento de la capacidad de culpabilidad como la valoración de la conducta de un imputado son en sí mismos procesos de interpretación que requieren del juzgador una actitud activa y determinante. Desde una perspectiva antropológica, y a partir de un caso tomado como campo para la reflexión, el artículo intenta analizar la incidencia de valoraciones sociales, morales, éticas e ideológicas que intervienen en un proceso penal donde se discute la declaración de inimputabilidad del acusado; así como también dar cuenta de las influencias y disputas establecidas entre los diversos discursos jurídicos ofrecidos en el desarrollo de la causa judicial.

One of the responsibilities of the Criminal Procedure is to determine whether certain events have occurred or not, in what terms and under what circumstances. Thus, "evidence" is a knowledge factor whose main function is to establish "the truth about the facts." However, both, the defendant's guilt probability as well as the appreciation of his/her behavior are themselves processes of interpretation that require the judge's active and decisive attitude. From an anthropological perspective and, considering a case to be reflected on, the article focuses on the intervention of social, moral, ethical and ideological evaluations involved in criminal proceedings where the defendant's incompetence is discussed. It also purports to account for established influences and quarrels among the various legal speeches deployed in the development of the legal case.
