Jujuy, campo de prueba: el derecho y la protesta

Abstract

El artículo analiza la reciente reforma de la Constitución provincial de Jujuy, llevada adelante en 2023, donde --entre otros cambios-- se introdujeron limitaciones al ejercicio del derecho de protesta, creando un nuevo derecho a la paz social y la convivencia democrática pacífica como base de tales restricciones. En particular, se revisa desde el punto de vista de su coherencia con la Constitución nacional y los tratados de derechos humanos de igual jerarquía, para señalar los aspectos que pueden entrar en contradicción.
