Este trabajo aborda los conflictos valorativos que los “viejismos” sociológicos y normativos producen en el Derecho actual. Para ello, se identifican las tensiones, problemas y desafíos de justicia que este tipo de adjudicaciones y de fuentes jurídicas plantean. Se analizan las razones sociales y razones alegadas que sostienen estos viejismos, y se establecen algunos remedios requeridos para deconstruirlos y poder elaborar nuevas respuestas humanistas.
This paper deals with the value conflicts that sociological and normative "age-isms" produce in current Law. So, this research identified the tensions, problems and challenges of justice that this type of adjudication and legal sources pose. Besides, it points out the social reasons and alleged reasons that sustain these "age-isms", and it propose some remedies to deconstruct them and to be able to elaborate new humanist responses.
